By downloading, installing, or using the MacroLift application and associated web properties provided by Dignix ("Company", "we", "us", "our"), you ("User", "you") agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you must not use the Services.
2. Medical, Health, and Nutrition Disclaimer
- No Medical Advice: MacroLift is designed strictly for informational, educational, and fitness tracking purposes. We are not a healthcare provider, and the Services do not constitute medical advice, diagnosis, or treatment.
- Assumption of Risk: The use of any workout routines, exercise instructions, or nutritional guidelines provided within the App is solely at your own risk. Exercise carries inherent risks of physical injury.
- Nutritional Accuracy Disclaimer: The nutritional information, macronutrient breakdowns, and calorie counts provided within the App's database are approximations derived from general data sources. They do not represent exact or guaranteed nutritional values. Actual values may vary significantly based on factors including, but not limited to, exact portion sizes, preparation methods, brand variations, agricultural differences, and product quality. Dignix makes no warranties regarding the absolute accuracy, completeness, or reliability of this dietary data.
- Physician Consultation: You should always consult with a qualified healthcare professional or certified nutritionist before beginning any new diet, fitness program, or progressive overload protocol.
3. Intellectual Property and Third-Party Media
- Company Content: All proprietary code, software architecture, UI/UX designs, structural models, text, and original graphics provided by the App are the exclusive intellectual property of Dignix and are protected by applicable copyright laws.
- Educational Use of Third-Party Media: The App contains exercise demonstration videos, GIFs, and media clips sourced from publicly available internet platforms. Dignix does not claim ownership, copyright, or exclusive rights to these specific media files. They are utilized strictly under the principles of "Fair Use" (or equivalent local doctrines) solely for educational, non-commercial instructional purposes to demonstrate proper exercise form.
- License to Use: We grant you a limited, non-exclusive, non-transferable, and revocable license to use the App for your personal fitness tracking.
4. Copyright Claims and Takedown Requests
Dignix respects the intellectual property rights of others. If you are the rightful copyright owner (or an authorized agent) of any video or media displayed within the App and believe its use infringes upon your copyrights, please submit a formal takedown notice to info@dignix.in.
Your notice must include:
- Identification of the copyrighted work claimed to have been infringed.
- The specific name of the exercise/video in the App where the material is located.
- Your contact information (name, address, email).
- A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner.
Upon receipt of a valid claim, we will promptly investigate and remove the media in question from our database.
5. User Accounts and Acceptable Use
- You must be at least 13 years old to use the Services.
- You are responsible for maintaining the confidentiality of your account credentials.
- You agree not to reverse-engineer the App, use automated scripts/scrapers to extract our database, or use the App in any manner that could disable or overburden our cloud infrastructure.
6. Disclaimer of Warranties
The Services are provided on an "AS IS" and "AS AVAILABLE" basis. Dignix makes no warranties, expressed or implied, regarding the accuracy, reliability, or availability of the App. We do not guarantee that the App will be uninterrupted, error-free, or entirely secure at all times.
7. Limitation of Liability
To the maximum extent permitted by applicable law, Dignix shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or personal injury (including injury derived from reliance on the App's workout or nutritional data), arising out of or in connection with your use or inability to use the Services.
8. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or related to these Terms or the Services shall be subject to the exclusive jurisdiction of the courts located in Maharashtra, India.
9. Termination
We reserve the right to suspend or terminate your account and access to the Services at our sole discretion, without prior notice, if you violate these Terms or engage in conduct that harms the integrity of the platform.
